These Terms of Service (“Terms”) govern your access to and use of MomentCut (the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service
MomentCut turns long videos into short vertical reels with captions, and can schedule and publish those reels to an Instagram account you connect. Features may change over time.
Eligibility & accounts
- You must be at least 14 (or the minimum age in your jurisdiction) and able to form a binding contract.
- You are responsible for activity under your account and for keeping your sign-in secure.
- To publish, you must connect an Instagram Business or Creator account that you own or are authorized to manage.
Your content & responsibilities
- You retain ownership of the videos and content you submit. You grant us a limited license to process, store and publish it solely to provide the Service.
- You confirm you have the rights to the content you upload and to publish the resulting reels.
- You will not use the Service to post content that is unlawful, infringing, or that violates Instagram’s and Meta’s terms and policies. You are responsible for complying with the rules of any platform you publish to.
- You will not abuse, reverse engineer, overload or attempt to disrupt the Service.
Instagram / Meta
Publishing relies on the Instagram API and is subject to Meta’s Platform Terms and Instagram’s policies. Instagram is a third-party service we do not control; its availability, limits and behavior may affect the Service. You authorize us to publish reels to your connected account at your direction.
Payment & minute credits
- Processing is paid for with prepaid minute credits, bought as one-time packs (€9 for 100 minutes, €29 for 400 minutes) through our payment processor, Stripe. There is no subscription and no recurring charge — nothing renews and there is nothing to cancel.
- One credit covers one minute of source video, rounded up to whole minutes, and is charged once per video after its length is known. The number of reels you keep from a video does not change the price. Credits do not expire.
- If processing fails before any clips are delivered to you, the credits for that video are returned to your balance automatically. If a failure happens after clips are delivered (for example while rendering an approved clip), the minutes stay spent and you can retry the render at no extra charge.
- Unused credits can be refunded within 14 days. If you change your mind, email us at lucas.erlacher.29@gmail.com within 14 days of a purchase and we will refund the credits you have not yet spent, back to your original payment method.
- Credits already used to process a video are not refundable, since the processing has been delivered. This does not affect any statutory rights you have as a consumer.
- Prices are in euro and include no VAT (small-business exemption). We may change prices with notice; a change never affects credits you have already bought.
Fair use
Credits are what you pay for, but to protect shared processing capacity each account may start up to 10 videos per rolling 24 hours, and we analyze at most the first 120 minutes of a source video — a longer video is processed up to that point (you are told, and billed only for those minutes), while anything over 180 minutes is rejected before download. These are capacity limits rather than billing limits: hitting the daily cap never consumes credits, and we may adjust it if it is being used to overload the Service.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or misuse the Service. On termination, your data is handled as described in our Privacy Policy.
Disclaimers & limitation of liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for losses arising from third-party platforms (including Instagram) or from content you publish.
Changes
We may update these Terms from time to time and will revise the “Last updated” date above. Continued use means you accept the updated Terms.
